Thank you for reviewing these terms and conditions governing your Wawa Gift Card (“Gift Card Rules”). The Gift Card Rules are between you and Wawa, Inc. (“Wawa” or “we”) and describe each party’s respective rights and obligations. These Gift Card Rules apply to all Wawa Gift Cards, whether purchased at a Wawa store locations, online at Wawa.com, or received from third parties. By purchasing or using a Wawa Gift Card, you indicate your acceptance of these Gift Card Rules.
2.1 Wawa Gift Cards are issued by Wild Goose Gift Card LLC, an affiliated company of Wawa. You can purchase Wawa Gift Cards at a Wawa store location, online at Wawa.com or by calling the Wawa Customer Relations team at 1-800-444-9292. Wawa Gift Cards are available for a minimum value of U.S. $5 and for up to a maximum value of U.S. $500; however, you can only put up to U.S. $250 on a Wawa Gift Card per transaction. Wawa prohibits the sale of Wawa Gift Cards in an aggregate amount exceeding U.S. $10,000 to any one person on any one day at a Wawa store or online. Purchases of Wawa Gift Cards in an aggregate amount exceeding U.S. $10,000 must be made through the Wawa Customer Relations team at 1-800-444-9292.
2.2 The dollar value on your Wawa Gift Card is prepayment only for purchases using your Wawa Gift Card. No credit card, credit line, overdraft protection or deposit account is associated with your Wawa Gift Card. No interest, dividends or any other earnings on funds deposited to a Wawa Gift Card will accrue or be pair or credited to you by Wawa.
3.1 You can use your Wawa Gift Cards at any Wawa store location. We reserve the right, in our sole discretion, to restrict the purchase of certain products with your Wawa Gift Card. Purchase amounts that exceed the value of your Wawa Gift Card will require an additional payment for the balance due. Subject to Wawa’s return policies, if you return a purchase made with your Wawa Gift Card, the purchase amount will be credited to your Wawa Gift Card or put on a newly issued Wawa Gift Card if the one you used to make the purchase is no longer available. At our discretion, we may also give you cash for a return purchase made with a Wawa Gift Card. For a return purchase made with more than one payment method, we will issue a credit to each of the applicable payment methods used. Unless otherwise required by law, any amount on your Wawa Gift Card is nonrefundable and may not be redeemed for cash. In New Jersey, gift cards with less than $5 are redeemable for cash on customer request. Similar requirements may apply in other states.
3.2 Your Wawa Gift Card does not have an expiration date. No fees apply to your Wawa Gift Card.
4.1 The balance remaining on your Wawa Gift Card is generally printed on your receipt after every transaction. You can also obtain the balance remaining on your Wawa Gift Card by asking a Wawa associate to check it for you at any Wawa store location, online at Wawa.com or by calling the automated Wawa Gift Card balance hotline at 1-877-217-5366. To obtain your balance information online or by phone, you will need to provide the unique card number and scratch-off pin number on the back of your Wawa Gift Card. If you are a member of the Wawa Rewards program (“Program”) and have registered your Wawa Gift Card to your Program account, you can check the balance remaining on you Wawa Gift Card by accessing your Program account on Wawa.com or through the Wawa mobile application. For more information about the Program, please refer to the Wawa Rewards Program Terms and Conditions and Frequently Asked Questions.
4.2 We reserve the right to correct the balance of your Wawa Gift Card if we believe that a clerical, billing or accounting error occurred. If you have questions regarding your transactions or any correction, or if you dispute any transaction or correction that has been assessed against your Wawa Gift Card, please contact us online at Wawa.com or through our Wawa Customer Relations team at 1-800-444-9292. You are responsible for monitoring your transactions and account balances.
5.1 You can reload your Wawa Gift Card at any Wawa store location, regardless of whether there are funds remaining on your Wawa Gift Card or whether it has a zero balance.
5.2 If you are a Wawa Rewards Program member, you also have the option through the Wawa mobile application or through Wawa.com of reloading active Wawa Gift Card(s) registered to your Program account. You may choose a one-time reload or ongoing automatic reloads when your Wawa Gift Card balance falls below a specified amount. Your credit card or debit card will be billed according to the amount you have selected. Automatic reloads generally occur within one hour after your Wawa Gift Card balance dips to or below the minimum balance you specified. We will notify you after each automatic reload confirming that your Wawa Gift Card has been loaded, the amount reloaded and the new balance. To disable automatic reloads, you must disable the automatic reload feature within at least one hour before your Wawa Gift Card balance dips to or below the minimum balance you specified for automatic reload in order to allow sufficient time for the change to go into effect. Once the dollar value is loaded, the transaction cannot be reversed.
You are solely responsible for the security of your Wawa Gift Card and for all transactions made with your Wawa Gift Card, including unauthorized transactions. Lost, stolen or damaged Wawa Gift Cards will not be replaced. However, if your lost, stolen or damaged Wawa Gift Card is registered to your Program account, we will replace it with a new one, up to the value remaining at the time of your call.
Wawa may change the Gift Card Rules at any time, with or without notice. Wawa will post the revised Gift Card Rules on its website. As permitted by applicable law, any such changes will become effective at the time Wawa posts the revised Gift Card Rules.
YOU AND WAWA AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS ACCESS TO DISCOVERY, ALSO MAY BE UNAVAILABLE OR LIMITED IN ARBITRATION.
8.1 Any claim or dispute between you and Wawa, its affiliated companies and their respective officers, directors, employee, agents or contractors arising from or relating to the Program or these Program Rules, will be resolved by binding arbitration before a sole arbitrator in Philadelphia, Pennsylvania administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules as supplemented by AAA Supplementary Procedures for Consumer-Related Disputes.
8.2 Prior to initiating any arbitration, you must first present any claim or dispute to Wawa by contacting the Wawa Customer Relations team at 1-800-444-9292 to allow for an opportunity to resolve the dispute. You or we may initiate arbitration if your claim or dispute cannot be resolved within 60 days.
8.3 All administrative fees and expenses of arbitration will be divided equally between you and Wawa during the course of the arbitration. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.
8.4 An arbitrator may not award relief in excess of or contrary to what this agreement provides, order consolidation or arbitration on a class wide or representative basis, or award damages aside from the prevailing party’s actual damages, or punitive damages, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute. Any arbitration will be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If one or more provisions of this arbitration clause is deemed to be illegal or unenforceable, the remainder of this arbitration clause shall be unaffected and shall continue to be fully valid, binding, and enforceable.
These Gift Card Rules will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws provisions.
If any provision of these Gift Card Rules is deemed to be illegal or unenforceable, the remainder of these Gift Card Rules shall be unaffected and shall continue to be fully valid, binding, and enforceable. Failure of Wawa to exercise or enforce any right or provision of these Gift Card Rules will not constitute a waiver of such right or provision in that or any other instance.
